We handled an international dispute
We advised the project's parties and brought the disputed matter to an amicable conclusion.
Problem
The Swedish construction company had a significant dispute in the fell village of Åre regarding the defects of the alpine huts. The matter started when the real estate developer/construction company received a complaint about the work of its subcontractor from the buyer of the project.
Solution
After receiving the complaint, it became clear that there were significant deficiencies in the construction project, so we prepared complaints for subcontractors, responses to buyers, notifications to insurance companies and recourse claims.
The dispute was resolved efficiently and amicably, with the insurance companies compensating part of the damage, our principal’s new subcontractor repairing part, and the buyer bearing part of the responsibility due to unclear instructions.
Overall, both the real estate developer and the buyer were very satisfied with the end result, which enabled the continuity of the joint business. We were able to process and show the true origin of the error and damage, its causes and responsibilities so clearly that the subcontractor and his insurance company could not dispute these and compensated most of the damage. Even the subcontractor was satisfied, because he got grounds for insurance compensation through our complaint, because the damage was unexpected and not caused by a construction defect.
